Terms of Service

These Terms of Service are an agreement between you and SOMA EdTech LLC, the operator of SharpFish Analytics. By creating an account, purchasing a subscription, or using the service, you agree to these Terms. If you use SharpFish for an organization, you represent that you have authority to bind that organization.

You must have the legal capacity to enter this agreement and may use SharpFish only for lawful purposes. If you cannot legally enter a binding agreement where you live, do not create an account or purchase a subscription.

SharpFish Analytics is a data analytics and market-intelligence service.

SharpFish is a subscription-based data analytics and NFL market-intelligence service. Features may include market monitoring, sportsbook market-data comparisons, point-spread analytics, lookahead market information, SharpFish Market Alerts, market-movement information, educational content, account dashboards, and historical records or performance information.

Features, coverage, sources, and presentation may change as the service develops. SharpFish may intentionally provide no recommendation or alert when its analytical standards are not met.

SharpFish Analytics is not a sportsbook, gambling operator, betting exchange, bookmaker, or wager-placement service. SharpFish does not accept wagers, hold wagering funds, or place bets on behalf of users.

SharpFish does not maintain wagering accounts, determine or settle wager outcomes, operate games of chance, access customer sportsbook accounts, or custody customer betting funds. If you independently choose to use a third-party sportsbook, that separate activity is governed by the third party’s terms and applicable law. SharpFish does not control that activity.

SharpFish outputs are data analytics, market intelligence, educational information, and analytical decision-support information. They are not instructions to transact and do not remove the need for independent judgment.

Models and analytics can be wrong. Markets can change quickly, and an alert or observed quote may become stale or unavailable. Historical results, backtests, model outputs, Signal Strength, Market Lean, Best Observed At, and other performance information do not guarantee future results, a winning outcome, profitability, a positive return, or any particular result.

You remain solely responsible for your decisions and actions. You are responsible for evaluating information independently, complying with laws and third-party terms applicable to you, deciding whether and how to act, and maintaining the confidentiality and security of your SharpFish credentials.

If you independently choose to wager through a third party, you are responsible for complying with applicable law and maintaining responsible behavior. SharpFish’s business is analytics and market intelligence, not wagering.

SharpFish may display or analyze information originating from third-party sportsbooks and data providers. Lines, prices, market availability, and timestamps can change, may differ by account or jurisdiction, and may be delayed, unavailable, incomplete, or corrected. SharpFish does not control third-party sportsbooks or guarantee the continued availability or accuracy of their information.

References to sportsbooks, leagues, teams, or other third parties are for identification and informational purposes. They do not imply affiliation, sponsorship, or endorsement unless SharpFish expressly says otherwise.

You must provide accurate account information and keep it reasonably current. You may not share credentials or permit unauthorized access to your account. Notify SharpFish through the Help Center if you believe your account has been compromised.

Website access is sold as one-time purchases: NFL Season Pass 2026 is $29.99, with access from purchase through February 16, 2027 at 12:00 AM ET; 30-Day Access is $9.99, with access for 30 days from purchase. Each is one payment, does not renew automatically, and carries no automatic recurring charge. Billing is processed by Stripe through Stripe-hosted checkout, and access begins after the payment is verified. A new purchase can be made once the current access period ends. If a payment is fully refunded or disputed, the access it provided ends. If a payment was fully refunded or disputed, contact support before making a new purchase.

Members who enrolled in an earlier monthly Website subscription, including at the Limited-Time Founding Member Rate of $1.99 per month, keep that subscription on its existing terms; it renews monthly until canceled. Those members may cancel anytime through the membership billing controls or Stripe Customer Portal. Cancellation stops future renewals. Where the current billing rules provide a paid-through period, access continues through that period and expires afterward unless another valid entitlement applies.

Prices, access periods and, for existing subscriptions, renewal terms are presented before payment authorization. Nothing in these Terms creates a general refund entitlement; any rights that cannot lawfully be limited remain unaffected.

SharpFish does not promise uninterrupted or error-free operation. Maintenance, provider or API failures, delayed data, internet or network failures, Telegram delivery interruptions, security events, and circumstances outside SharpFish’s control may delay, limit, suspend, or make parts of the service unavailable.

SharpFish may temporarily suspend features or the service when reasonably necessary for maintenance, security, legal compliance, or platform integrity.

SharpFish and its licensors retain rights in the SharpFish name and logo, site design, software, models, algorithms, methodology, scoring systems, alert logic, proprietary data transformations, and original written content. Your subscription grants a limited, personal, non-exclusive, non-transferable right to use the service while your access remains valid.

You may not scrape, reverse engineer, resell, redistribute, reproduce, systematically extract, attack, or use proprietary SharpFish outputs to create a competing product except where applicable law expressly permits and that permission cannot be waived.

NFL team names, team logos, sportsbook names, and other third-party marks belong to their respective owners. SharpFish does not claim ownership of those third-party marks.

SharpFish may restrict, suspend, or terminate an account for fraud, abuse, unauthorized sharing, credential sharing, scraping, attacks, misuse, nonpayment, legal or security risk, or a material violation of these Terms. SharpFish will apply this authority reasonably in light of the circumstances and applicable law.

To the fullest extent permitted by law, SharpFish is provided “as is” and “as available.” SOMA EdTech LLC disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not limit any warranty or right that applicable law does not permit us to exclude.

To the fullest extent permitted by law, SOMA EdTech LLC and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, wagering losses, or losses arising from reliance on market information. To the fullest extent permitted by law, aggregate liability arising from the service will not exceed the subscription fees you paid to SharpFish during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

SharpFish may update features and these Terms. Material changes will be posted with an updated effective date and, when appropriate, additional notice. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise. If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
